Simon & Sigalos, LLP wins major Federal Court case for client

Simon & Sigalos, LLP is pleased to announce a major court victory it obtained on behalf of one of its corporate clients.  The firm successfully represented The Learning Experience Systems, LLC (“TLE”), a nationally known franchisor and operator of childcare and early childhood education centers, which is headquartered in Boca Raton, Florida.  The case involved a lawsuit brought against TLE by a franchisee claiming millions of dollars of damages for alleged breaches of contract, alleged misrepresentation, alleged violations of federal and state securities laws, as well as other alleged statutory violations.  The lawsuit was filed in the United States Disrict Court for the Southern District of Florida and presided over by the Honorable Robin L. Rosenberg.  Simon & Sigalos, LLP aggressively defended the suit on behalf of TLE and counterclaimed for substantial damages against the franchisees.  After extensive discovery proceedings in both the State of Colorado and the State of Florida, the case was tried before the Honorable Robin L. Rosenberg during the first two weeks of June in West Palm Beach, Florida.  The trial lasted two weeks and involved dozens of witnesses and thousands of pages of exhibits.  On July 31, 2015, the Court issued a ninety-six-page ruling finding in favor of TLE on all counts of the complaint and the counterclaim and entitling TLE to a judgment against the franchisees for nearly a million dollars.  (Copy of the Court’s opinion can be found here)

Firm partner, George L. Sigalos, was lead trial counsel on behalf of TLE and firm associates, Jennifer Boussy Carroll and Heather E. Kruzyk acted as second and third chair at trial.  All three lawyers actively litigated the case from start to finish on behalf of TLE and worked very hard over the past year to obtain these favorable results for the firm’s client.
